Interested in having a booth? The first step is to fill out the vendor application. Approved vendors will be sent an online payment link.

The 2025 Farmers Market will be held every Saturday, May 10 through Sept 27 from 8:30am - 12pm rain or shine at 506 S. Main St in Aberdeen, SD.

This market is intended for growers, farmers, bakers, and makers (no resale of items you purchased already made/complete, no rummage sale, etc)

In order to provide an organized and consistent Farmer’s Market for all we ask those interested to submit a vendor application.

There are two options to join the market:

$15 per 10'x10' space each Saturday you sign up

$75 per 10'X10' space for entire season

Expectations:

  1. No soliciting (walking around approaching customers) for political/voting agendas, petitions, or similar. I understand doing so may result in denial of participation in the Farmers Market. No refund will be issued.

  2. The Farmers Market is held rain or shine and the decision to attend is at the discretion and responsibility of each vendor. In the event of a severe weather warning (tornado, lightning) issued, that includes the farmers market location during date/time of scheduled market, vendors who paid a weekly rate and were not able to attend any part of it will be able to apply that payment to a future date open. We will not issue cash refunds. No compensation of any sort is provided for travel, time, product expiration, loss/damage, or any other costs related to vendor choosing not to attend.

  3. Signing up for certain dates indicates a commitment to attend as a vendor. If you have selected a date and can no longer attend please notify promptly via Malchow Plaza Farmers Market facebook page messenger or malchowplazafarmersmarket@gmail.com. Choosing to not notify us and repeated last minute cancellations will result in suspension of future events.

  4. Please notify the Committee if adding any unscheduled dates by the Monday prior to the anticipated Saturday event you would like to attend. This allows for planning and assigning of space. We cannot guarantee a spot if we are full that week.

  5. The Farmers Market begins at 8:30am. Vendors should be set up and ready to sell by this time. You can expect some customers to show up early.

  6. We will make every effort to keep the booth location the same for vendors who have paid for the season but cannot guarantee every week.

  7. No booth sharing with vendors not approved by the board. Every vendor MUST fill out an application and be pre-approved. Only approved vendors may share space if desired. Fee must be paid by each business and cannot be split for the space.

  8. The Malchow Plaza Farmers Market is intended for locally grown and hand-made items made or grown by the vendor. No resell or MLM items allowed. Repeat violations of this rule will result in suspension of attendance. If you have questions about a product please ask a board member.

  9. You are responsible for tracking, reporting and paying Dept of Revenue all sales tax from your sales. Click here for access to the tax form.

  10. If you are selling consumable items, you are responsible for knowing and following SD Cottage Food Laws, Dept. of Health, Animal Industry Board and all other regulatory agency laws and guidelines regarding products you sell. For more information click here.

Vendor Liability Waiver & Agreement

THIS VENDOR LIABILITY WAIVER ("Waiver") is entered into effective as of the date of your vendor application submission in consideration for you ("Releaser" or "Vendor") receiving permission to enter, occupy or otherwise make use of selling space (the "Market Space") for the MALCHOW PLAZA FARMERS MARKET (the "Market").

AGREEMENT

  1. General Release. In consideration of the use of the Market Space I, for myself, my employees, agents, representatives, and assigns, hereby release and hold harmless the Market, and its representatives, volunteers, coordinators, sponsors, affiliates, promoters, property owners, and other participating vendors ("Releasees"), from all claims of negligence resulting in personal injury, accident, illness (including death) or property damage arising from or relating to my participation in the Market and use of the Market Space. I understand that individual product liability and liability for my market display is my responsibility, legally and financially.

  2. Assumption of Risk. In executing this release, I acknowledge that participation in the Market and use of the Market Space carries certain inherent dangers/risks that cannot readily be eliminated regardless of the care taken to prevent and avoid injury, and hereby additionally assume the risk of liability for injury, accident, or illness, including death, resulting from such dangers and the acts or omissions of Market customers, vendors or other members of the public. I understand that the description of the risks in this Waiver is not complete and that other risks or events arising from participation in the Market or use of the Market Space, both known or unknown, anticipated or unanticipated, may result in serious bodily injury, death, or property damage.

  3. Indemnification. I agree to indemnify, defend and hold harmless the Releasees, through their own choice of counsel, against any and all claims, causes of action, liability, judgments, obligations or costs of any nature arising out of or related to the negligent or intentional acts or omissions of myself, my employees, agents, representatives or assigns in connection with my participation in the Market or use of the Market Space, including any acts or omissions undertaken in contravention.

  4. Compliance with Laws. I agree to obey all laws, ordinances, rules and regulations adopted or established by Federal, State, or local governmental agencies or bodies while participating in the Market or using the Market Space. This includes, but not limited to, submitting all appropriate Sales Tax to the South Dakota Department of Revenue as well as following all South Dakota Cottage Laws and Department of Health guidelines/laws.

  5. Media Release. In further consideration for my use of the Market Space, I authorize the "Releasees" the use of my likeness or identifying information in any publications or publicity materials, including but not limited to, magazines, internet and web content, newsletters, newspapers, and other means of advertising, without any compensation or fee being paid.

  6. I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OF AGE OR OLDER, I HAVE READ THIS WAIVER, I AM FREELY AND KNOWINGLY AGREEING TO ALL OF THE PROVISIONS OF THIS WAIVER, AND I UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS OF THE WAIVER. BY SIGNING OR TYPING YOUR NAME BELOW, YOU ARE AGREEING THAT YOU UNDERSTAND AND WILL ABIDE BY THE RULES AND REGULATIONS.
